Earn Income Credit, do I qualify?

Hello my question is regarding the Earn Income Credit. My brother lived with me for all of the 2009 year. During this year he was unable to work due to Cough-Variant Asthma and lung problems. He has since been cured and started working again in 2010. So in a sense he was disable for the entire year due to his illness. Can I claim the EIC?? I made less than 15,000 and the credit is 3,000 more for him, so I hope I can. I did provide for him all year and Yes we do have documentation and ready to provided if asked. any suggestions?

  1. EIC amounts only increase with qualifying children. Declaring your brother as a dependent will not help your EIC.
  2. In order for your brother to qualify as your "qualifying child" he would have needed to be permanently and totally disabled. Since he has been cured he obviously was not permanently disabled. Sorry, but while you may be able to claim your brother as a dependent, unless he was under the age of 19 (24 if a student) and younger than you, you cannot claim him for EIC purposes.
  3. another question on the same subject? EIC is based on your earned income and children in your home under the age of 17 I suspect your brother is beyond that age
